By selecting services under one of the Bernville Quality Fuels, Inc. Home Heating Security Plans, customer and Bernville Quality Fuels, Inc. agree to the following terms and conditions:

1. The effective period of this plan shall be for one year commencing from the date of subscription, subject to prior Bernville Quality Fuels, Inc., inspection and approval of customer’s heating equipment as suitable for inclusion under this plan.
2. This plan covers only those repairs and replacement of parts specified herein which result from normal operation of heating equipment, during the effective period of the plan.
3. This plan does not cover water leaks, water damage, or damage caused by excessive dampness in customer’s basement.
4. Bernville Quality Fuels, Inc. shall not be liable for failure or delay to provide the service called under this plan if such failure or delay results from:
   a. Strike or other labor disturbance
   b. Fire
   c. Flood
   d. Lightning or power surges
   e. Other acts of God
   f. Supply Shortages
   g. Governmental laws or regulations
   h. Supplier’s inability to supply parts
   i. Failure of customer’s supply of electricity
5. Bernville Quality Fuels, Inc. shall not be liable under this plan for customer failure to use ordinary care in the operation of heating equipment, including but not limited to: customer failure to keep adequate water in the boiler (if applicable), blown fuses, failure to turn on main switch, thrown circuit breakers, or any other cause unrelated to normal operation of heating equipment or which may affect Bernville Quality Fuels, Inc. ability to fulfill its obligations under the terms in this plan.
6. Fuel flow problems directly related to outside storage of fuels are not covered under this plan.
7. Low pressure, rotary-type, and wood/oil combination units are not covered under this plan.
8. If when due to age or obsolescence, it is no longer practical to continue servicing customer’s equipment, Bernville Quality Fuels, Inc. will modernize said
   equipment (with customer approval and at customer’s expense) which will continue this agreement.
9. Liability under this plan is limited to the services specified. Bernville Quality Fuels, Inc. shall not be liable for any consequential damages in any way arising out of performance or non-performance under this agreement.
10. This plan shall be automatically renewed unless cancelled by either party giving notice in writing to the other prior to the expiration date.
11. All parts, equipment and/or labor not covered in this plan will be charged to the customer at prevailing rates. They are:
    • Humidifiers (unless plan D)
    • Flue Devices (Power Ventors, Draft Inducers, etc.)
    • Electronic Air Cleaners (unless plan D)
    • Heat Distributing Units (radiators, baseboard radiation, piping, ductwork, etc.)
    • Boiler and Jacket on Hot Water Units
    • Domestic Hot water coil and tempering valves
    • Automatic water feeders (unless plan D)
    • Zone valves (unless plan D)
    • Relief valves (unless plan D)
    • Flow control valve (unless plan D)
    • Motorized zone dampers
    • Air conditioning, Lp Gas and Heat Pump equipment
12. All Heating oil and LP Gas requirements must be purchased from Bernville Quality Fuels, Inc. during the term of this agreement under the automatic delivery system and paid for under the credit terms established.
13. Any customer who switches from automatic delivery to will call or is switched by the credit department to will call due to credit problems, their service contract shall be null and void. NO Refunds.
14. Draining expansion tank and/or bleeding air from the radiation is not covered under Plan B or Plan C. This can be done at the time of the cleaning upon request.
15. Circulator bearing assembly is not covered under Plan C.

NOTE: THE UNIT MUST BE CLEANED OR APPROVED BEFORE THE CONTRACT CAN GO INTO EFFECT.
